3.1      Passing of Tasmanian Artist, Mr Tom Samek

 

The Lord Mayor acknowledged the recent passing of Czech/Tasmanian artist, Tom Samek.

 

Born in Prague, Tom moved to Tasmania at 21.  He described himself as a painter, sculptor, printmaker, mural artist, theatre set designer and film animator.

 

Tom was behind some of Tasmania's most well-known art works, including the floor mural Flawed History of Tasmanian Wine at Meadowbank Estate.

 

Council commissioned Tom to undertake three projects:

 

·         Wellington Court Playground (1997);

 

·         Gold Fish - Railway Roundabout Fountain pool mosaic (2013). Geoff Parr the original designer of the fountain specified that when it was refurbished in 2013 he wanted Tom to redo his own work done 50 years earlier; and

 

·         Foxtrot Polka Dot (2019) in collaboration with Tom O’Hern (officers call it the Tom and Tom wall) located on the ramp leading from Wellington Court to the Argyle St car park.

 

He was an artist of great diversity and immense skill and above all else, Tom was a valued member of Hobart’s artistic community who will be greatly missed.

5.1.1   Ms Louise Elliot - UTAS and Elected Member Allowances

 

 

Ms Elliot put the following questions which were taken on notice by the Lord Mayor.

1.    UTAS’ Urban Design Framework document that covers its move to the CBD outlines dramatic changes to our City. These changes will no doubt be welcomed by some, while being forcibly imposed on others to their detriment.

Some of these changes include UTAS’ intention to “develop Melville Street as a pedestrian priority street” and to expand their property portfolio to over a dozen large, prime real estate sites in the central CBD. The community is already seeing UTAS’ wishes coming to fruition through the removal of considerable on-street parking in Elizabeth Street and more plans for similar underway.  

Can the Council please advise:

·         what, if any, assurances has the Council or its representatives given UTAS that the plans UTAS has outlined in their Urban Design Framework are or will be supported by the Council?

·         what is the Council’s understanding of what making Melville Street pedestrian priority means in real terms? For example, is this blocking the street to traffic, making the street one-way, and/or removing some or all parking?

·         what, if any, plans do the Council have to consult with the residents and businesses in the areas impacted by the Council’s plans for Hobart’s streets?

·         how does the Council expect UTAS’ move to the City to impact rates revenue, in particular:

o   what rates does the Council estimate would be payable if the real estate currently and proposed to be occupied by UTAS in the CBD was instead occupied by a party that did not have exemption from paying rates? Or put another way, how much rates income is UTAS’ move to the CBD costing in terms of missed rates revenue?

 

 

o   what, if any, properties in the Hobart LGA does UTAS currently pay rates on and what is the value of those rates?

2.    In April 2020 a motion was put forward by the Lord Mayor and Councillor Sherlock seeking that all elected members take a voluntary 20 per cent reduction in their allowance. The motion was lost with the Lord Mayor, and Councillors Sherlock, Dutta and Ewin voting in support of the motion.

Can the Council please advise if this motion needed to be supported in order for elected members to action a voluntary reduction in their allowance or was it possible for members to take their own independent action to reduce their allowance without this motion being raised or supported?

Assuming that members could reduce their allowance without the motion being supported, can the council please advise which, if any, of the four elected members that voted in support of this motion actioned a voluntary reduction in their allowance since April 2020 and the value of the reduction made per member?

Topic:                          Engagement - North Hobart Parking

 

Question:

 

At Council’s last meeting 23 August 2021, Alderman Zucco questioned the Director of City Innovation Mr Carr, if he had consulted with John Kelly of the North Hobart Traders Association prior to the installation of parking meters being installed at Elizabeth St North Hobart.

 

His response was “YES” - he had consulted with me.

 

As I have previously advised all elected members and the CEO on 20 August 2021, I maintain that no consultation had been made.

 

The Director’s response effectively labels me as a liar.

 

Could the Director of City Innovation please provide the evidence of the consultative process that he engaged with John Kelly of the North Hobart Traders Association regarding the installation of parking meters at Elizabeth Street North Hobart, as he claimed at the Council meeting of 23 August 2021 and how this followed any of the guidelines in the Community Engagement Framework Policy?


Council Response:


At no stage at the Council meeting of 23 August 2021 did the City’s Director City Innovation label you as a liar.  I appreciate that you may feel that his response has this effect, however I do not consider it appropriate to imply this was the Director’s intention – particularly in a public question.

 

As was explained in an answer to another question asked at the same meeting, the Council undertook a range of engagement activities in North Hobart in development the draft Place Vision and Access and Parking Plan of which a component part was the installation of parking meters in Elizabeth Street, North Hobart.

The City’s approach is in accordance with Council’s adopted Engagement Framework which can be found on our website at hobartcity.com.au/Community/Community-engagement.

As a member of International Association for Public Participation (iap2.org.au) the City is committed to community engagement and seeks to undertake activities that:

•     are inclusive and accessible to members of the community

•     create an active and informed dialogue

•     achieve good governance by facilitating open, fair and constructive dialogue

•     allow for informed decision-making

•     understand the views and aspirations of the community.

The engagement activities that were undertaken in North Hobart in developing the draft Place Vision and Access and Parking Plan, took place in 2020, Stage One was the development of the Place Vision and Parking and Access Plan, involved three visioning workshops with local residents, property owners and traders, in Feb 2020 the Local Residents and Community Workshop had 86 participants and the Local Business Managers/Owners Workshop had 11 participants.

There were four Access and Parking workshops also held in Feb 2020, the Local Residents and Community Workshop had 82 participants and the Local Business Managers / Owners Workshop had 16 participants.

Interviews were also undertaken with the former and current Presidents of the North Hobart Traders Association, representatives from key transport agencies and advocacy groups, and cultural clubs in the Precinct, including Italian and Greek communities and the Chinese Community Association of Tasmania.

 

We had 45 on the street survey responses (referred to as intercept surveys) and 531 online survey responses.

 

In 2021 Stage Two, the understand community support for the Draft Place Vision and Parking and Access Plan was undertaken. This involved an online survey attracting 295 responses, stakeholder meetings with North Hobart Community Associations and North Hobart Trader Association and Walk and Talk with North Hobart Traders.

In both stages there was extensive promotion of the engagement activities through direct mail out to businesses and residents, social media, e-newsletters and postcard and cinema campaign.

While, I appreciate that you may not have been personally directly involved with some of this consultation, the opportunity was clearly there for you to have participated.  I also understand that you have corresponded and met with the Director City Innovation in relation to this matter.  Specifically, I note that you corresponded with the Director, and the Chairperson of the Council’s Finance and Governance Committee, Alderman Marti Zucco, via email on 17 November 2020 where you expressly commented that you did not support the proposal to have paid parking in Elizabeth Street.

Topic:                          Planning and Building Data

 

Question:

 

As you are aware, the Council publishes a summary of planning and building data on its website. This information does not, however, tell the full picture as it only contains applications that were approved.

While more information is accessible in the Council minutes and meeting recordings which are publicly available, this information is weaved into these items making it is difficult to get an overview of the data and trends.

The Council has already recognised the value of providing summary information given information on approved applications is already provided. 

A couple of weeks ago, I wrote to the Lord Mayor requesting that the scope of the summary information provided to the public be expanded so that a more comprehensive picture is easily accessible to the community. I have since received a response from the Director of Planning that this would not be possible due to resource constraints.

Given the dire situation of Hobart’s housing affordability – which is commonly acknowledged as being fundamentally due to the imbalance of supply and demand – I believe that the community deserves access to the full picture of what is happening when the council acts as a planning authority. Every new home in our City is filtered through the council. The decisions made by elected members have an undeniable impact on housing supply.

Consistent with valuing transparency, I thereby request that the council agree to provide the community with a fuller picture and commit to finding the resources needed to do so. 

Specifically, I ask the Council to provide the community with:

·     a cumulative summary of each occasion where the Council acts as a Planning Authority on all housing and hotel planning applications (including dwellings, multiple dwellings, student accommodation, change of use to visitor accommodation, and parcels of land) which states:

·    the date of the Council’s decision

·    the title of the application and associated reference numbers

·    the number of dwellings and/or hotel rooms included in the application

·    what recommendation the Council’s planning officer have made

·    the votes cast by each Elected Member so it is easily clear which Elected Members did and did not support the planning application and

·    the overall result of the application.

 

Response:

The Council is in the process of expanding current data it provides to the public on development activity in the City of Hobart.

 

It is intended to have, by December, an interactive dashboard that will show statistics around planning approvals, particularly focussed on dwelling and visitor accommodation, for the period 1 January 2016 to the present month. Users will be able to filter the results based on various attributes and this information will also be provided in a map view configuration, allowing users to drill down to individual properties.

 

This is based on similar offerings at other capital cities and like other capital cities, it is not intended to include any voting record nor officer recommendations. Clearly decisions will be provided, however, the voting record of individual elected members, while of interest to some, is not relevant to the fundamental purpose of providing this information, which is to provide information on development activity.

Additional data will be regularly added to the dashboard over time, particularly measuring our performance against development projections in major strategic planning strategies such as the Sothern Tasmania Regional Land Use Strategy and the future Greater Hobart Metropolitan Plan.

Topic:                          Council Debt and Expenditure Prioritisation

 

Question:

 

There are a few parts to my question which relates to the Council’s debt and how it prioritises its expenditure.

The Council’s Budget Estimates state that as of 30 June 2021, the Council was over $66 million in debt and that over $2 million in interest will be incurred this year. The Council’s Long Term Financial Plan forecasts debt to increase to $70m and that the debt won’t be cleared until 2040.

The Council has recently raised its rates and fees, despite housing costs being the highest we have ever seen, and businesses and the broader community struggling with the ongoing economic impacts of COVID.

In this context, can the Council please advise:

Question 1

·    how the Council intends to pay this debt back, such as through further rates and fee increases and/or the creation of additional income streams (such as further parking restrictions) and/or finding savings and carefully prioritising its expenditure to core services

Question 2

·    how much interest is expected to be accrued in total over the life of this debt

Question 3

·    why it has not been possible for the Council to manage its expenditure so that it does not go into debt, like the Clarence City Council has which has zero debt

Question 4

·    what projects have been identified within the City Amenity and City Innovation divisions but are unable or unlikely to proceed this financial year due to insufficient funds being available, such as the installation of water fountains and bottle fillers in the waterfront to help reduce the impact of plastics which cannot proceed without external funding and

Question 5

·    how the Council views the following sample items of expenditure as a sound investment at any time, but especially given the Council’s current financial position. Payments of:

o $10,000 for poems to be placed in buses for four months

o $5,000 to teach a small selection of people how to DJ

o $13,200 on a runway performance show that aims to remind us that we are all beautiful

o $15,000 for art materials

o $5,000 for barbershop singing

o $3,000 for a prisoners’ art exhibition

o $15,000 for dancing that responds to the Rivulet

o $15,000 for an art walking tour that’s available for three days.

These items are only a sample of what many view as highly questionable use ratepayer funds, particularly given the Council’s financial situation and that the State Government already provides over $5 million in grants each year through Arts Tasmania and Screen Tasmania.

Response:

Question 1

 

The City’s forecasts assume that debt is funded through annual income of which rates are a significant proportion. The Council’s Long Term Financial Management Plan indicates that rates are expected to increase between 2.75 per cent and 3 per cent as shown in the table on page 87 of the Special Meeting of all Council Committees – 16/6/2021 (http://hobart.infocouncil.biz/Open/2021/06/JM_16062021_AGN_1461_AT_EXTRA.PDF)

Question 2

On page 114 of the Special Meeting of all Council Committees – 16/6/2021 highlights the interest costs for the interest payments on debt and the interest on leased assets. Over the remaining 15 year life of the debt, the total interest that will be paid is $13 million.

Question 3

The primary reason for local government borrowings is the size of the capital works program in each municipal area. For 2021-22 the City of Hobart has a capital works plan of $42.96 million compared to Clarence’s program of $21.45 million for the same period.

Question 4

The City undertakes a process to prioritise all works and projects when developing its annual budget as it is never possible to fund all requests.

Staff also actively pursue opportunities to secure external funding to assist with the implementation of various projects and programs.

The City’s 2021–22 budget includes an allocation to enable the replacement (or installation of new) drinking fountains with this program being implemented accordingly.

Question 5

The City of Hobart grants program is guided by the Hobart: A community vision for our island capital and the Capital City Strategic Plan 2019–29. The Council has for many years supported the City in delivering a significant grants program that support community-driven activities to provide for connection, empowerment and self-expression.

6.       Petitions

 

6.1      Making Augusta Road, Lenah Valley safe for all road users

 

The Chief Executive Officer tabled a petition from Mr Dustin Moore of Lenah Valley calling for the Council to:

  • monitor and gather vehicle travel speeds on the section of Augusta Road between Giblin Street and Athleen Avenue
  • investigate and report on crash data on the section of Augusta Road between Giblin Street and Athleen Avenue since the installation of the pedestrian refuge in June 2015
  • investigate and implement within a reasonable timeframe, in consultation with the local community, a multi-modal solution for the section of Augusta Road between Giblin Street and Athleen Avenue that is nationally consistent with safe system infrastructure and knowledge, which may involve, but is not limited to, reducing opportunities for vehicles speeding, providing separated and protected cycleways and planting street trees.

There were 73 signatories to the petition.

9.       Council Acting as Planning Authority

 

In accordance with the provisions of Part 2 Regulation 25 of the Local Government (Meeting Procedures) Regulations 2015, the intention of the Council to act as a planning authority pursuant to the Land Use Planning and Approvals Act 1993 is to be noted.

 

In accordance with Regulation 25, the Council will act as a planning authority in respect to those matters appearing under this heading on the agenda, inclusive of any supplementary items.

 

The Council is reminded that in order to comply with Regulation 25(2), the Chief Executive Officer is to ensure that the reasons for a decision by a Council or Council Committee acting as a planning authority are recorded in the minutes.

 

9.1      26 Newdegate Street, North Hobart - Partial Demolition, Alterations and Extension

That pursuant to the Hobart Interim Planning Scheme 2015, the Council approve the application for partial demolition, alterations and extension at 26 Newdegate Street, North Hobart 7000, as it satisfies the heritage provisions of the Hobart Interim Planning Scheme 2015 and a permit containing the following conditions be issued:

The use and/or development must be substantially in accordance with the documents and drawings that comprise PLN­21­457 ­ 26 Newdegate Street North Hobart TAS 7000 ­ Final Planning Documents except where modified below.

 

Reason for condition

 

To clarify the scope of the permit.

 

ENG sw1

 

All stormwater from the proposed development (including but not limited to: roofed areas, ag drains, retaining wall ag drains and impervious surfaces such as driveways and paved areas) must be drained to the Council’s stormwater infrastructure prior to first occupation or commencement of use (whichever occurs first).

 

Advice: Under section 23 of the Urban Drainage Act 2013 it is an offence for a property owner to direct stormwater onto a neighbouring property.

 

Reason for condition

 

To ensure that stormwater from the site will be discharged to a suitable Council approved outlet.

 

ENG 1

 

Any damage to council infrastructure resulting from the implementation of this permit, must, at the discretion of the Council:

 

1.       Be met by the owner by way of reimbursement (cost of repair and reinstatement to be paid by the owner to the Council); or

2.       Be repaired and reinstated by the owner to the satisfaction of the Council.

 

A photographic record of the Council's infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.

 

A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre­ existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. In the event that the owner/developer fails to provide to the Council a photographic record of the Council’s infrastructure, then any damage to the Council's infrastructure found on completion of works will be deemed to be the responsibility of the owner.

 

Reason for condition

 

To ensure that any of the Council's infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

 

ENV 1

 

Sediment and erosion control measures sufficient to prevent sediment from leaving the site must be installed prior to any disturbance of the site, and maintained until all areas of disturbance have been stabilized or re­ vegetated.

Reason for condition

 

To avoid the sedimentation of roads, drains, natural watercourses, Council land that could be caused by erosion and runoff from the development, and to comply with relevant State legislation.

 

HER 17a

 

The palette of exterior colours, materials and finishes must reflect the palette of colours, materials and finishes within the local streetscape, precinct and heritage listed house.

 

Prior to the issue of any approval under the Building Act 2016, revised plans must be submitted and approved as a Condition Endorsement showing exterior colours, materials and finishes in accordance with the above requirement.

 

All work required by this condition must be undertaken in accordance with the approved plans.

Advice: This condition requires further information to be submitted as a Condition Endorsement. Refer to the Condition Endorsement advice at the end of this permit.

 

Reason for condition

 

To ensure that development at a heritage place and heritage precinct is undertaken in a sympathetic manner which does not cause loss of historic cultural heritage significance.

ii.   Acknowledges that this target is important for playing our part to avoid dangerous climate change and meeting it will require significant changes to how we plan, build, manufacture and travel in the City of Hobart

iii.  That in recognition of our role as the capital city and the emissions generated within our LGA, request that the CEO undertake an assessment and provide recommendations on how the City will prepare for and strengthen its existing strategies, targets, practises and policies so that the City can assist in meeting this zero by 2030 target.

iv.  That this assessment look broadly to harmonise and standardise our organisation’s approach and consider our role operationally and as a policy-maker including in planning, community development, waste, transport, corporate energy efficiencies and natural resources management.

v.   Seek a meeting with the Premier and Climate Change Minister to discuss the opportunities for collaboration on emission reductions projects and policies in the City of Hobart, and also authorises the CEO to make a submission to the Bill to amend the Climate Change Act.

(i)    To determine all planning permit applications which would otherwise be determined by the Council, after the last ordinary scheduled Council meeting in December 2021 and before the first ordinary scheduled Council meeting in January 2022, in circumstances where it would not otherwise be possible to determine the application within the statutory time period required under Sections 57(6), 57(6A), 58(2) or 58(2A) of the Land Use Planning and Approvals Act 1993, and an extension of time cannot be obtained, unless an Elected Member has requested the convening of a special meeting or meetings to determine the application and there is sufficient time to arrange a special meeting prior to the expiry of the statutory time period required under those sections.

2.    An annual grant of $47,855 (exc GST) be provided to the Domain Tennis Centre Inc for a period of three (3) years to assist with the maintenance of the Domain Tennis Centre.

3.    An annual grant of $34,338 (exc GST) be provided to the Southern Tasmanian Netball Association for a period of three (3) years to assist with the maintenance of the Hobart Netball and Sports Centre.

4.    Each grant provided to commence in the current (2021-22) financial year.

5.    All grant funding must be utilised to asset maintenance that will extend the life of the financial assets that are under lease.

6.    The grant recipients provide an annual grant request submission which must outline the proposed use of the City’s annual maintenance grant, with an annual grant acquittal to be provided to the Council and assessed prior to the City’s consideration of the subsequent year grant submission.

 

7.    An increase to subsequent year grant funding be linked to the rate of Hobart CPI.

8.    The value of each grant be recorded in the City’s Annual Report in accordance with the Council Policy ‘Grants and Benefits Disclosure’.
