The Chairman reports that she has perused the minutes of the meeting of the Open Portion of the Council meeting held on Monday, 18 September 2017, and the minutes of the Open Portion of the Special Joint Meeting of all Council Committees held on Tuesday, 26 September 2017, finds them to be a true record and recommends that they be taken as read and signed as a correct record.

In accordance with the provisions of Part 2 Regulation 25 of the Local Government (Meeting Procedures) Regulations 2015, the intention of the Council to act as a planning authority pursuant to the Land Use Planning and Approvals Act 1993 was to be noted.

 

In accordance with Regulation 25, the Council will act as a planning authority in respect to those matters appearing under this heading on the agenda, inclusive of any supplementary items.

 

The Council was reminded that in order to comply with Regulation 25(2), the General Manager is to ensure that the reasons for a decision by a Council or Council Committee acting as a planning authority are recorded in the minutes.

Pursuant to the Hobart Interim Planning Scheme 2015, the Council approve the application for Partial Demolition, Alterations and Multiple Dwelling at 9 Beddome Street, 7 Beddome Street, 11 Beddome Street, and 1 Niree Heights, Sandy Bay for the reasons outlined in the officer’s report attached to item 7.2.1 of the Open City Planning Committee agenda of 25 September 2017 and a permit containing the following conditions be issued:

The use and/or development must be substantially in accordance with the documents and drawings that comprise PLN­16­00232­01 ­ 9 Beddome Street ­ SANDY BAY ­ Final Planning Documents except where modified below.

 

 

Reason for condition

 

 

To clarify the scope of the permit.

The use and/or development must comply with the requirements of TasWater as detailed in the form Submission to Planning Authority Notice, Reference No. TWDA 2016/00495­HCC dated 22 April 2016 as attached to the permit.

The new storm water connection must be constructed and any existing connections to be abandoned sealed by the Council (see advice below) at the owner’s expense, prior to the first occupation.

 

 

Detailed engineering drawings must be submitted and approved, prior to commencement of work. The detailed engineering drawings must include:

 

 

1.      The location of the proposed connection; and

2.      The size of the connection appropriate to satisfy the needs of the development.

 

 

All work required by this condition must be undertaken in accordance with the approved detailed engineering drawings.

 

Advice:

 

 

The proposed stormwater connection to the kerb and gutter can also be built by a private contractor who has first obtained a Road Opening Permit from the Council. The stormwater connection should pass to the south (not the north) of the existing Telstra pit to avoid the edge of the driveway crossover. The stormwater connection must be straight and have a continuous gradient.

 

 

Once the detailed engineering drawings have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

 

 

Where building approval is also required, it is recommended that documentation for condition endorsement be submitted well before submitting documentation for building approval. Failure to address condition endorsement requirements prior to submitting for building approval may result in unexpected delays.

 

 

Please note that once the condition endorsement has been issued you will need to contact Council’s City Infrastructure Unit to initiate an application for service connection.

 

 

Reason for condition

 

 

To ensure the site is drained adequately.

 

 

ENG 2

 

 

Vehicle crash barriers compliant with the Australian/New Zealand Standard AS / NZS 1170.1 must be installed prior to the first occupation.

 

 

A certified design/report prepared by a suitably qualified engineer, to satisfy the above requirements, must be provided to the Council prior to the issuing of any permit under the Building Act 2016.

 

 

All works, required by this condition must be undertaken in accordance with certified design/report. Upon completion the barriers must be inspected by a qualified engineer and a certification submitted to the Council, confirming that the installed barriers comply with the above requirement.

 

 

Advice: vehicle crash barriers should be raised to a minimum height of 1m to ensure pedestrian safety, or a handrail or balustrade mounted on top of barriers

 

 

Reason for condition

 

To ensure that the safety of users of the driveway/parking and compliance with the standard.

 

 

ENG 4

 

 

The driveway and car parking area approved by this permit must be constructed to a sealed standard and surface drained prior to the commencement of use.

 

 

Reason for condition

 

 

To ensure safe access is provided for the use.

 

 

ENG 3

 

 

The driveway, car parking and manoeuvring areas must be constructed in accordance with certified driveway design drawings, prior to the first occupation.

 

 

The design of these areas must:

 

 

1.       Be prepared by a suitably qualified engineer who must certify that the design is in accordance with the Australian Standards AS/NZS 2890.1 or that the design provides for a safe and efficient access.

 

 

Upon completion of the driveway and parking areas, documents signed by a suitably qualified engineer, certifying the driveway has been constructed in accordance with the certified design drawings must be lodged with the Council.

 

 

Reason for condition

 

 

To ensure that the safety of users of the driveway/parking.

 

 

ENG 14

 

 

Parking, access and turning areas must be generally designed and constructed in accordance with the Australian Standard Parking facilities, Part 1: Off­Street Carparking, AS 2890.1 2004, prior to the first occupation.

 

 

Design drawings must be submitted and approved, prior to commencement of work. The design drawings must show:

 

1.       Dimensions, levels and gradients, transitions and other details as necessary to satisfy the above requirement.

2.       Adequate sight distance for vehicles exiting the driveway (this may require the removal of existing large shrubs alongside the driveway ­ drawings must clearly show the minimum extent of vegetation removal).

 

 

All work required by this condition must be undertaken in accordance with the approved design drawings.

 

 

Advice:

 

 

Once the design drawings have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

 

 

Where building approval is also required, it is recommended that documentation for condition endorsement be submitted well before submitting documentation for building approval. Failure to address condition endorsement requirements prior to submitting for building approval may result in unexpected delays.

 

 

Reason for condition

 

 

To ensure that the access and parking layout for the development is to accepted standards.

 

 

ENG 1

 

 

The cost of repair of any damage to the Council’s infrastructure resulting from the implementation of this permit, must be met by the owners within 30 days of the completion of the development or as otherwise determined by the Council.

 

 

A photographic record of the Council’s infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.

 

 

A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre­existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. In the event that the owner/developer fails to provide to the Council a photographic record of the Council’s infrastructure, then any damage to the Council’s infrastructure found on completion of works will be deemed to be the responsibility of the owner.

 

 

Reason for condition

 

To ensure that any of the Council infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

 

 

ENV 1

 

 

Sediment and erosion control measures sufficient to prevent sediment from leaving the site must be installed prior to any disturbance of the site. Sediment controls must be maintained until all areas of disturbance have been stabilized or re­vegetated.

Reason for condition

 

 

To avoid the sedimentation of roads, drains, natural watercourses, Council land that could be caused by erosion and runoff from the development, and to comply with relevant State legislation.

It is recommended that the developer liaise with the Council’s Cleansing and Solid Waste Unit regarding reducing, reusing and recycling materials associated with demolition on the site to minimise solid waste being directed to landfill.

That:   1.    The preparation of the further report in relation to the planning scheme amendments concerning building heights within the CBD, as resolved by the Council on 3 July 2017, also consider non-discretionary maximum height controls in the area covered by the Central Business, Commercial, and Urban Mixed Zones under the Hobart Interim Planning Scheme 2015, and the area covered by the Sullivans Cove Planning Scheme 1997.

(b)     Asset renewal works and funding that might otherwise provide an opportunity to consider tree planting installations, as suggested in the City’s Street Tree Strategy, is not scheduled at this time.

2.    Council officers make contact with the lead petitioners to organise an onsite meeting as soon as practicable to discuss the options available to address the matters of concern raised in the petition.

3.    The Council write to the owners of the building, advising of the concerns raised in the petition in relation to the unsightly façade located at the rear of Magnet Court and request for consideration be given to the possibility of beautifying the façade by way of rendering, if appropriate.

20.      Hill Street Pedestrian Improvement Project

3.    The findings of the Midson Traffic Report (marked as Attachment C to item 6.6 of the Open City Infrastructure Committee agenda of 20 September 2017) be endorsed and the following recommendations be adopted:

(i)      A trial implementation of a wombat crossing across Hill Street (on the northern side of the Pine Street roundabout) be undertaken, subject to further consultation with directly impacted property owners, residents and businesses and all statutory advertising and approvals.

(ii)     Results of the trial, including recommendations on the installation of two additional wombat crossing in Hill Street (at both Warwick Street and Patrick Street), be the subject of a further report.

(iii)    Further surveys of pedestrians and pedestrian types over a longer period (i.e. one school week) be done at the Patrick Street roundabout and the results forwarded to the Transport Commissioner for consideration of a children’s crossing and adult crossing guard.

(iv)    Traffic signals not be implemented at the Arthur Street / Hill Street or Patrick Street / Lansdowne Crescent / Hill Street intersections at this time.

4.    The required funding for the installation of wombat crossings at Warwick Street and Patrick Street (if not trialled) be listed for consideration in the 2018‑19 Annual Plan, with installation contingent on a successful trial and future resolution of Council.

2.    Conditional in-principle approval be given for the developer of the Hyatt (Palace) Hotel to implement lane closures and road closures from mid-December 2017 for approximately 20 months until the works are complete, including:

(i)      The closure of the westbound traffic lane in Elizabeth Street (Macquarie Street to Collins Street) at all times.

(ii)     Full closure of Elizabeth Street (Macquarie Street to Collins Street) on weekends from Saturday 6am to Monday 6am (approved on a case-by-case basis), to accommodate the erection and dismantling of a tower crane.

3.      The General Manager be authorised to modify and/or withdraw the above approval due to concerns around road safety or traffic management.

4.      The approval be subject to the following conditions:

(i)      Consultation and notification of the closures be undertaken with those properties directly affected by the proposed works and adequate advanced warning be given to the travelling public (including public transport operators and their customers).

24.      River Derwent Ferry Transportation

That:   1.    The Council request, as a matter of urgency, the Tasmanian Government to progress its Southern Integrated Transport Plan 2010 particularly in areas of multi-modal integrated ticketing, real time transport data and connected transport routes.

2.    The General Manager to write to Clarence City Council, Kingborough Council and Glenorchy City Council with the intent of seeking a commitment from the STCA to resource a joint study into the potential for development around a number of ferry centric nodes in a way that provides density (demand), attractions (visitors), amenity (cafes and other services) and links to transport, walks, etc with each having a unique and locally appropriate character.

3.    The Council establish a smaller working group from the participants of the forum to act as a working and reference group with participants to be invited by the General Manager.

4.    The Lord Mayor be asked to write to all participants thanking them for their input and further advising on the Council's next steps.

COUNCIL RESOLUTION:

 

That:   1.    The Council request the Tasmanian Government to progress its Southern Integrated Transport Plan 2010 particularly in areas of multi-modal integrated ticketing, real time transport data and connected transport routes.

2.    The Council seek a commitment from STCA and particularly neighbouring councils (Brighton Council, Clarence City Council, Glenorchy City Council and Kingborough Council) to resource a joint study to examine the potential for development around a number of ferry centric nodes in a way that provides density (demand), attractions (visitors), amenity (cafes and other services) and links to transport, walks, etc with each having a unique and locally appropriate character.

3.    The Council seek commitment, in the form of a Memorandum of Understanding, from the Tasmanian Government and neighbouring councils (Brighton Council, Clarence City Council, Glenorchy City Council and Kingborough Council) to jointly undertake a business case for proceeding with the most promising options for a River Derwent ferry service. 

i.    The business case to provide the state and local government along with the wider community information so as to assess whether they consider it represent a good and appropriate use of public funds.

4.    The Council commit to contribute up to $20000 for a potential:

i.     joint study on existing docking facilities and the development of ferry centric nodes; and

ii.    joint business case for a River Derwent ferry service,

to be funded from the contractors- business management allocation in the Economic Development Function of the 2017-18 Annual Plan.

5.    The Council establish a smaller working group from the participants of the forum to act as a working and reference group with participants to be invited by the General Manager.

6.    The Lord Mayor be asked to write to all participants thanking them for their input and further advising on the Council's next steps.

 


 

 

25.      Sister-City Visit to L'Aquila and UTAS Study Tour to Frieburg, Cambridge and Going Global Conference, London

That:   1.         To further strengthen the sister-city relationship with L’Aquila, the Council provide in principle approval for the opportunity to sponsor, in conjunction with UTAS and the Abruzzese Association, a young person of Abruzzese descent to have the opportunity to study in L’Aquila for a period of time.

(i)    A further report be provided detailing how such a proposal could work and the associated cost.

2.         The Lord Mayor invite the current and former Mayors of L’Aquila to the 20-year Anniversary celebrations to be held in October 2017 or the 20-year Anniversary of L’Aquila’s first visit to Hobart being March 2018.

3.         The Council give consideration to future annual or biennial visits to L’Aquila to participate in the Plenary Indulgence ceremony in line with the Capital City Strategic Plan and a further report be provided.

4.         The Council note the learnings from the visit to Freiburg and Cambridge and apply these in ongoing discussions with UTAS as well as the State Government with regard to a city deal for Hobart.
