In accordance with the provisions of Part 2 Regulation 25 of the Local Government (Meeting Procedures) Regulations 2015, the intention of the Committee to act as a planning authority pursuant to the Land Use Planning and Approvals Act 1993 is to be noted.
In accordance with Regulation 25, the Committee will act as a planning authority in respect to those matters appearing under this heading on the agenda, inclusive of any supplementary items.
The Committee is reminded that in order to comply with Regulation 25(2), the General Manager is to ensure that the reasons for a decision by a Council or Council Committee acting as a planning authority are recorded in the minutes.

Memorandum: City Planning Committee
83 Melville Street, Hobart - Partial Demolition and
Alterations - PLN-17-822
At its meeting of 13 February 2018, the Council’s City Planning Committee resolved to defer supplementary item 11 relating to planning application PLN-17-822 that proposes partial demolition and alterations at 83 Melville Street, Hobart. The Committee’s resolution was as follows:
That the matter be deferred to a Special City Planning Committee meeting prior to the Council meeting on 19 February 2018, to allow further discussions to take place between the applicant, the architect for the 1990’s element of the building, and Council officers, with adequate details provided to Alderman prior to the Special meeting.
The Committee’s resolution has been forwarded to and discussed with the applicant, All Urban Planning. Following discussion of the resolution with their client, the building’s owners, the applicant has indicated that they would prefer not to meet to discuss the application as outlined in the Committee’s resolution, citing the following reasons:
· It is understood that the representations relate to the 1990’s portions of the buildings that do not form part of the heritage place under the Planning Scheme;
· The representations do not raise matters that are relevant to Council’s consideration under the Planning Scheme;
· Council and the THC have confirmed that the internal demolition works are exempt from the provisions of the Planning Scheme and the Historic Cultural Heritage Act;
· The building owners have responded to Professor Morris-Nunn in relation to the matters raised under the Copyright Act 1968. The requirements of that act do not raise matters that are relevant to Council’s assessment of the planning application.
The applicant’s response also states:
For Council’s information, the project architect, John Button from HBV has previously offered in good faith to meet with Professor Morris-Nunn with no response. However, given the Council’s interest, Mr Button has today extended a further invitation to meet along with the building owner and myself.
We believe that it is important that the issues raised by the representors or any discussions do not confuse Council’s assessment of the application under the Planning Scheme and look forward to Council’s determination of the matter this Monday 20 [sic] February.
A full copy of the applicant’s correspondence is attached to this memorandum.
As such, the applicant’s preference is for the application to be determined by Council as currently proposed. The application’s statutory timeframe expires on Tuesday 20 February 2018.
The officer recommendation in relation to the application is contained within the report to the City Planning Committee meeting of 13 February 2018. It recommends that the application be approved subject to conditions. That report is attached to this memorandum.
The City Planning Committee resolution also requires that:
…adequate details [of the proposal be] provided to Alderman prior to the Special meeting.
It is understood that this component of the resolution relates to the legibility of the annotations upon one of the drawings that comprises the application, that being drawing A201, Rev. B dated 17.01.18 showing the Melville Street elevation. That drawing is shown in Figure 1 below, with Figure 2 showing an enlargement of the annotations upon that drawing.

Conclusion
It is recommended that the application be approved subject to conditions in accordance with the officer recommendation contained within the report to the City Planning Committee meeting of 13 February 2018.
That: Pursuant to the Hobart Interim Planning Scheme 2015, the Council approve planning application PLN-17-822 for partial demolition and alterations at 83 Melville Street, Hobart for the reasons outlined in the officer’s report dated 8 February 2018 and a permit containing the following conditions be issued: GEN The use and/or development must be substantially in
accordance with the documents and drawings that comprise PLN-17-822 - 83
MELVILLE STREET HOBART TAS 7000 - Final Planning Documents except where
modified below. THC The use and/or development must comply with the
requirements of the Tasmanian Heritage Council as detailed in the Notice of
Heritage Decision, THC Works Ref: 5455 dated 13 February 2018 as
attached to the permit. ENG 1 The cost of repair of any damage to the Council's
infrastructure resulting from the implementation of this permit, must be met
by the owners within 30 days of the completion of the development or as
otherwise determined by the Council.
A photographic record of the Council’s infrastructure
(e.g. existing property service connection points, roads, buildings,
stormwater, footpaths, driveway crossovers and nature strips, including if
any, pre-existing damage) will be relied upon to establish the extent of
damage caused to the Council’s infrastructure during construction. In
the event that the owner/developer fails to provide to the Council a
photographic record of the Council’s infrastructure, then any damage to
the Council's infrastructure found on completion of works will be deemed to
be the responsibility of the owner. ENV 1 Sediment and erosion control measures sufficient to prevent
sediment from leaving the site must be installed prior to any disturbance of
the site, and maintained until all areas of disturbance have been stabilized
or re-vegetated. HER s4 The new entrance must be relocated to
allow retention of façade brickwork and window to Melville Street
façade. Prior to the issue of any approval under the Building Act
2016, revised plans must be submitted and approved showing: 1. Retention of the heritage listed 1920s building façade, with windows and brickwork; and 2. Revised location of the new entrance, for example on the return (side) wall. All work required by this condition must be undertaken in accordance with the approved revised plans.
ADVICE The following advice is provided to you to assist in the
implementation of the planning permit that has been issued subject to the
conditions above. The advice is not exhaustive and you must inform yourself
of any other legislation, by-laws, regulations, codes or standards that will
apply to your development under which you may need to obtain an approval.

condition above, you will need to submit the relevant documentation to
satisfy the condition via the Condition Endorsement Submission on
Council's online services e-planning BUILDING PERMIT You may need building approval in accordance with the Building
Act 2016. Click here for more information. PLUMBING PERMIT You may need plumbing approval in accordance with the Building Act 2016, Building Regulations 2016 and the National Construction Code. Click here for more information.
OCCUPATION OF THE PUBLIC HIGHWAY You may require a permit for the occupation of the public highway for construction or special event (e.g. placement of skip bin, crane, scissor lift etc). STORM WATER Please note that in addition to a building and/or plumbing permit, development must be in accordance with the Hobart City Council’s Hydraulic Services By law. Click here for more information. WORK PLACE HEALTH AND SAFETY Appropriate occupational health and safety measures must be employed during the works to minimise direct human exposure to potentially-contaminated soil, water, dust and vapours. Click here for more information. WASTE DISPOSAL It is recommended that the developer liaise with the
Council’s Cleansing and Solid Waste Unit regarding reducing, reusing
and recycling materials associated with demolition on the site to minimise
solid waste being directed to landfill.
