In accordance with the provisions of Part 2 Regulation 25 of the Local Government (Meeting Procedures) Regulations 2015, the intention of the Committee to act as a planning authority pursuant to the Land Use Planning and Approvals Act 1993 is to be noted.
In accordance with Regulation 25, the Committee will act as a planning authority in respect to those matters appearing under this heading on the agenda, inclusive of any supplementary items.
The Committee is reminded that in order to comply with Regulation 25(2), the General Manager is to ensure that the reasons for a decision by a Council or Council Committee acting as a planning authority are recorded in the minutes.

REcommendation That pursuant to the Hobart Interim Planning Scheme 2015, the Council refuse the application for the Partial Demolition, Extension and Alterations at 107 Lansdowne Crescent, West Hobart for the following reasons:
1. The proposal does not meet the acceptable solution nor the performance
criteria in respect
to Part E 13.8.1
of the Hobart Interim Planning Scheme
2015 in that
the proposed demolition (partial demolition) of the existing
roof form involves an irreversible loss of an element which contributes to the significance of the building and to the character of the Heritage
Precinct overall. 2. The proposal does not meet the acceptable solution nor the performance
criteria in respect
to Part E 13.8.2
of the Hobart Interim Planning Scheme
2015 in that it involves construction of an extension which lessens the significance of the Heritage Precinct and would result in an erosion of significance caused by a reduction in the quality and intactness of a single storey Federation house which contributes to the overall significance of the Precinct. 3. The proposal does not meet the acceptable solution nor the performance criteria in respect to Part E 13.8.2 of the Hobart Interim Planning Scheme 2015 in that it involves loss of the existing roof form and the construction of a rooftop addition, thereby compromising the integrity and appearance of the existing residence, and the extent to which the building can contribute to the significance of the Heritage Precinct. .

ENG 2
Vehicle crash
barriers compliant with the Australian/New Zealand Standard
A certified design/report prepared by a suitably qualified Engineer, to satisfy the above requirements, must be provided to the Council prior to the issuing of any permit under the Building Act 2000.
All works, required by this condition must be undertaken in accordance with certified design/report. Upon completion the barriers must be inspected by a qualified engineer and a certification submitted to the Council, confirming that the installed barriers comply with the above requirement.
Reason for condition
To ensure that the safety of users of the driveway/parking and compliance with the standard.
ENG 4
The driveway and car parking areas approved by this permit must be constructed to a sealed standard and surface drained prior to the first occupation.
Reason for condition
To ensure safe access is provided for the use.
ENG 11
The proposed crossover on the Sandy Bay Road highway reservation must be designed and constructed in general accordance with the following Municipal Standard Drawings, to the satisfaction of the Council's Director City Infrastructure, prior to the commencement of the use:
1. Urban TSDR09v1 – Urban Roads Driveways and TSD R14v1 Type KC vehicular crossing, or
2. Nonstandard K&C a concrete plinth to Councils standards shall be constructed at the gutter, contact Council’s Road Services Engineer for details.
Advice: It appears that a nonstandard crossover is required at this location. Designer should consult Council’s Road Services Engineer for further advice.
Reason for condition
In the interests of vehicle user safety and the amenity of the development.
ENG 3
The driveway, car parking and maneuvering areas must be constructed in accordance with certified driveway design drawings, prior to the first occupation.
The design of these areas must:
1. Be prepared by a suitably qualified engineer, who must also certify that the design is in accordance with the Australian Standards AS/NZS 2890.1 or that the design provides for a safe and efficient access.
Upon completion of the driveway & garage, documents signed by a suitably qualified engineer, certifying the driveway has been constructed in accordance with the certified design drawings must be lodged with the Council.
Reason for condition
To ensure that the safety of users of the driveway/parking.
ENG 14
Parking, access and turning areas must be generally designed and constructed in accordance with the Australian Standard Parking facilities, Part 1: OffStreet Carparking, AS 2890.1 – 2004, prior to the first occupation.
Design drawings must be submitted and approved, prior to commencement of work. The amended design drawings must:
1. show dimensions, levels and gradients, transitions and other details as necessary to satisfy the above requirement.
All work required by this condition must be undertaken in accordance with the approved design drawings.
Advice: The designers should ensure that adequate maneuvering space will be provided so that all B85 vehicles can turn around onsite and exit in a forward direction. Once the design drawing has been approved Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).
Reason for condition
To ensure that the access and parking layout for the development is to accepted standards.
ENG 1
The cost of repair of any damage to the Council infrastructure resulting from the implementation of this permit, must be met by the owners within 30 days of the completion of the development or as otherwise determined by the Council.
A photographic record of the Council infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.
A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. In the event that the owner/developer fails to provide to the Council a photographic record of the Council’s infrastructure, then any damage to the Council infrastructure found on completion of works will be deemed to be the responsibility of the owner.
Reason for condition
To ensure that any of the Council infrastructure and/or siterelated service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.
ENG 10
The front fencing and gate at 732A Sandy Bay Road must allow adequate sight distance between user vehicles, cyclists and pedestrians.
Amended drawings must be submitted and approved, prior to the commencement of work. The amended drawing must demonstrate how the fence/wall either side of the driveway entry provides for adequate sight distance between user vehicles, cyclists and pedestrians by one of the following methods:
1. Compliance with Australian/NZ Standard, Parking facilities Part 1: Offstreet car parking AS/NZS 2890.1: 2004 Fig 3.3; 2. Increasing the gate width of the driveway to ensure that it has a minimum clear opening width of 5.0m; 3. Increasing the transparency of fencing for at least 1m on each side of driveway/s so that those sections of fencing are largely transparent; or 4. Setting driveway(s) gates back 1m from front fence line to achieve increased sight lines.
All work required by this condition must be undertaken in accordance with the approved drawings.

Reason for condition
To ensure the safety of vehicles entering and leaving the development and of pedestrians and traffic in the vicinity.
ENV1
Sediment and erosion control measures sufficient to prevent sediment from leaving the site must be installed prior to any disturbance of the site. Sediment controls must be maintained until all areas of disturbance have been stabilized or re vegetated.

Reason for condition
To avoid the sedimentation of roads, drains, natural watercourses, Council land that could be caused by erosion and runoff from the development, and to comply with relevant State legislation.

The proposed works must be designed and constructed to ensure the protection of and access to the Council’s stormwater infrastructure.
A detailed engineering design must be submitted and approved prior to commencement of works. The detailed design must:
a. Demonstrate how the design will ensure the protection of and provide access to the Council’s stormwater main. b. Include crosssections which clearly indicate the relationship between the works (including footings and relocated sewer main) and the main, stating minimum proposed setbacks from the outside edge of the main.
All work required by this condition must be undertaken in accordance with the approved design.
Advice: Once the detailed design drawings has been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement). Council requires access for activities such as CCTV or jetting the main – a manhole is not necessary.

To ensure the protection of the Council’s hydraulic infrastructure.
ENG 2
Vehicle safety barriers where required by Australian Standard AS/NZS2890.1:2004, compliant with AS/NZS1170.1:2002 must be installed prior to the commencement of use.
A certified vehicle crash barrier design (including site plan with proposed location(s) of installation), prepared by a suitably qualified engineer, to satisfy the above requirements, must be submitted and approved by Council prior to the issuing of any permit under the Building Act 2000. All works, required by this condition must be undertaken in accordance with certified design.
Prior to the issuing of any Completion Certificate under the Building Act 2000, barriers must be inspected by a qualified engineer and a certification submitted to Council, confirming that the installed barriers comply with the above requirement.
Advice:
Designers are advised to consult the National Construction Code 2016 to determine if pedestrian handrails or safety barriers compliant with the NCC2016 are also required: http://www.abcb.gov.au/Resources/NCC.
Council do not consider a slope greater than 1 in 4 to constitute a lower level as described in AS/NZS 2890.1:2004 Section 2.4.5.3.
The drop from the proposed driveway to the below courtyard should be considered when assessing vehicular barrier requirements.

A stormwater management report and design must be submitted and approved, prior to issue of any consent under the Building Act 2000 or commencement of works (whichever occurs first). The stormwater management report and design must:
1. Be prepared by a suitably qualified engineer;
2. Include detailed design of the proposed treatment train, including final estimations of contaminant removal; and
3. Include a Stormwater Management Summary Plan that outlines the obligations for future property owners to stormwater management, including a maintenance plan which outlines the operational and maintenance measures to check and ensure the ongoing effective operation of all systems, such as: inspection frequency; cleanout procedures; descriptions and diagrams of how the installed systems operate; details of the life of assets and replacement requirements.
All work required by this condition must be undertaken and maintained in accordance with the approved stormwater management report and design.
Advice: Once the stormwater management report and design has been approved Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

ENG 7
The number of car parks approved on the site is eighteen (18). The parking area must be lined marked on the site prior to the commencement of the use.
All parking spaces must be delineated by means of white or yellow lines 80mm to 100mm wide, or white or yellow pavement markers in accordance with Australian Standards AS/NZS2890.1 2004 and/or AS/NZS2890.6: 2009 prior to commencement of use.
Detailed design drawings of the car parking must be submitted and approved, prior to the commencement of works.
The drawing must:
1. Show the layout of the car parking for the eighteen (18) parking spaces in accordance with the Australian Standards AS/NZS 2890.1:2004 and AS/NZS 2890.6:2009, to satisfy the above requirement.
2. Show wheel stops for car parking spaces 714 to prevent conflict with pedestrians on the footpath.
3. Show bollards (or approved equivalent that maintains vehicular and pedestrian sight lines in accordance with AS/NZS 2890.1:2004) along the front boundary where vehicular access points are not present, to prevent unauthorised vehicular access to the Council footpath.
4. Show two (2) 3.6m wide vehicular crossovers and vehicular access points in accordance with TSDR09v1 with a minimum kerb length between crossovers of 1.0m
5. Show new vehicular crossovers clear of existing bus stop.
6. Show separate entry and exit vehicular access points, and a one way aisle system.
All work required by this condition must be undertaken in accordance with the approved drawings.

A photographic record of the Council infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.
A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. Professional Development Reporting - Global Compact of Mayor, Carbon Disclosure Project Asia and Workshop
At the invitation of the ‘Global Covenant of Mayors for the Climate and Energy,’ (the Global Covenant) Aldermen Harvey accompanied by Katrina Graham, Environment and Climate Change Officer, attended the launch of the 2016 Carbon Disclosure Project (CDP) Cities report and participated in a 2 day workshop on the 11th – 12th October 2016 at the UN Conference Centre, Bangkok, Thailand. The Global Covenant covered travel, accommodation and meal expenses.
The Global Covenant event was attended by representatives from: Indonesia (Bali, Bogor and Denpasar), Sri Lanka (Western Province and University of Sri Jayawardenepura), Malaysia (Petaling Jaya), Philippines (Batangas, Dipolog and Mandaluyong), Thailand (Bangkok Metropolitan Administration) and Australia (Penrith City Council).
The City, following a resolution of the Council, formally joined the Global Covenant on the 9 Dec 2015. In doing so it committed to report using the Global Covenants online tools and reporting requirements that were covered in the two-day workshop: the CDP for corporate and community carbon emissions and the newly released Climate Risk and Adaptation Framework and Taxonomy (CRAFT) for adaptation.
The CDP is a not-for profit which, since 2000, runs global disclosure systems that enables cities, companies states and regions to measure their environmental impacts, through self reporting using tools for carbon emissions , water use and deforestation. The Global Covenant uses CDP as the platform for cities to report on emission as it enables: the establishment of accountability and best practice protocols, reporting better quality and consistent data at a global level and furthers the setting of new norms. The workshop covered the requirements such as the greenhouse gas protocol, emissions scopes and data inputs necessary for the use of the tool.
The CRAFT tool has been developed to provide a standardised adaptation reporting of local climate impacts and hazards, risk and vulnerability assessments and adaptation planning and implementation. It is integrated into the CDP reporting and is comprised of three reporting modules: profile the city, understand the problem and plan respond and monitor. Importantly it enables cities to benchmark against one another and identify cities with similar hazard profiles and examples of actions to inform their adaptation planning processes and implementation.
The event provided many interesting insights to mitigation and adaptation efforts across our Asia Pacific region, as well broader and the related issues of resilience, governance and geopolitics. It was particularly interesting to note that climate change science was widely accepted across the Asia region, however action appeared to be limited due to issues of resourcing and access to ‘good quality information’ (climate models) and data (energy use).
Additionally, as a courtesy, Alderman Harvey and Ms Graham arranged a separate meeting, on the 13th October, with representatives from Bangkok councils and the Thailand Government to share knowledge and experience on respective climate, energy and waste programs.
The meeting was attended by the Thailand Greenhouse Gas Management Organisation (established by Royal decree), the Bangkok Metropolitan Administration (BMA) and the Nonthaburia council. The presentations by the three organisations were very impressive and demonstrated an understanding of the issues faced and a commitment to action.
The BMA noted that they already face a plethora of issues around current liveability and management of resources (power, waste, water supply, riverine (Khlong) flooding and air quality) and that additional pressure on and intensification of these due to climate change was a considerable concern. They had however been assisted by the Japanese International Cooperation Agency (JICA) in the development of Bangkok Master Plan on Climate change 2013- 2023. Additionally there was international aid resourcing to assist the development of climate adaptation actions such as planting of bamboo walls and mangroves to assist in flood management. They noted however there were still considerable gaps in resourcing, capacity and institutional governance arrangements for full implementation of the plan.
Of particular interest to them was the City’s Home Energy Audit Toolkit, in particular the Take it Home program for primary and secondary schools. They had developed a waste recycling program for schools and were interested to replicate a similar program around energy use across the school community.
The Lord Mayor has written to the representatives from Bangkok councils and the Thailand Government, thanking them for hosting the meeting and offering to reciprocate if the opportunity arose in the future.

REPORT TITLE: New Fees Associated with Building Act 2016
REPORT PROVIDED BY: Acting Manager Development Compliance
1. Report Purpose and Community Benefit
1.1. The purpose of this report is to seek approval for new fees to be implemented associated with the commencement of the new Building Act 2016 and Building Regulations on 1 January 2017.
2. Report Summary
2.1. The new Building Act changes the way building, plumbing and demolition approvals are made. New fees are required to be introduced to align with the new approval process.
2.2. A summary of the proposed fees are as follows:
2.2.1. New demolition permit - the proposal is for the fee to be $200.
2.2.2. New notifiable building work - the proposal is for the fee to be $150.
2.2.3. New notifiable plumbing work - the proposal is for the fee to be $350.
That: 1. The report be received and noted. 2. The Council approve the following fees to apply from 1st January 2017: (i) Demolition permit - $200. (ii) Notifiable building work - $150. (iii) Notifiable plumbing work - $350.

4. Background
4.1. With the commencement of the new Building Act there a number of provisions for Council to charge new fees due to changes to approvals.
4.2. For new building, plumbing and demolition work, there is a new approach to the way approvals are granted to owners before work can start. There is a new division of all building, plumbing and demolition work into broad ‘risk categories’. The level of risk decides the approval process required.
4.3. A separate approval process has been introduced for demolition only work. Previously for demolition only work a full building permit was required.
4.4. There is a new category (Category 3) of building work referred to as “notifiable” building work for medium risk building work. A private building surveyor will assess the proposed work and will be authorised to issue approval for the work to proceed. The building surveyor will notify the Council that the work will be undertaken, and then notify the Council again when the work is complete. Council is required under the Building Act to keep a register of all records associated with notifiable building work.
4.5. There is a new category of plumbing work referred to as “notifiable” plumbing work for medium risk plumbing work. The Council’s plumbing compliance officers will assess the proposed work and give approval for the work to proceed.
4.6. There are also two additional new categories that do not require any building consent process, namely:
4.6.1. Category 1 – Low Risk Building Work that can be undertaken by an owner, competent person, or a licensed builder.
4.6.2. Category 2 – Low Risk Building Work that can only be undertaken by a licensed builder or a licensed demolisher.
4.7. The changes are designed to align the regulatory approval process to the level of risk involved with the works that are proposed.
5. Proposal and Implementation
5.1. It is proposed that Council formally adopt the new proposed fees.
5.2. The implementation of the new fees will start with the commencement of the new Building Act on 1 January 2017.
6. Strategic Planning and Policy Considerations
6.1. There are no direct strategic planning and policy implications.
7. Financial Implications
7.1. There will be revenue received that reflect Council’s administration role under the new Building Act and a possible reduction in revenue and administrative work associated with the changes. The loss in revenue is not expected to impact on this financial year given the significant amount of building activity and the above budget trend for the year to date revenue figures. We will monitor the changes in revenue as a result of the changes and have those impacts reflected in future budget years.
8. Legal, Risk and Legislative Considerations
8.1. Council is required to undertake its statutory responsibilities under the Building Act by processing the new approvals.
9. Social and Customer Considerations
9.1. The new fees are due to the implementation of the new Building Act. It is expected that there will be significant support for the reduction in the regulatory responsibilities commensurate with the risk level for the work being undertaken.
10. Delegation
10.1. This matter is delegated to the Council.
