11.1 Alderman Harvey - Illegal Demolition of Heritage Buildings - Maximum Penalties File Ref: 13-1-10 |
Question: Could the Director please advise if there is any scope to be able to combine the maximum penalties applicable under the Land Use Planning and Approvals Act 1993 and the Historic Cultural Heritage Act 1995, for those individuals/developers whom illegally demolish heritage buildings? Answer: The Director City Planning took the question on notice. |
11.2 Alderman Burnet - Buildings on Watkins Avenue Right-of-Way File Ref: 13-1-10 |
Question: Could the Director please advise if it is typical for buildings to be constructed on right-of-ways like those currently constructed on the Watkins Avenue right-of-way and does it need to be addressed? Answer: The Director City Planning advised that he was aware of buildings being constructed on other rights-of-ways like those in Watkins Avenue, however as the Council does not have jurisdiction over the protection of private rights-of-way in situations where encroachments are long standing it is a matter for individual land owners to use their own civil rights to protect their individual interests. |
11.3 Alderman Denison - Slate Roof Alternatives on Heritage Buildings File Ref: 13-1-10 |
Question: Could the Director please advise if there is any scope to expedite planning consent for proposals to replace a slate roof on heritage listed properties to a slate roof look alike product when a roof on a heritage listed property is in need of repair or replacement? Answer: The Director City Planning advised that an investigation together with an inspection has been conducted within this area to determine whether there are any contributing factors that may be attracting vermin to the area, however he is satisfied that the waste that is being generated in adjacent businesses is being stored correctly and is not contributing to the vermin issue. |
11.5 Alderman Ruzicka - Building Permits and SWMP's File Ref: 13-1-10 |
Question: In relation to the issuing of building permits and approval of SWMPs, can the Director please advise what steps can be taken, for example developer defaults, and is there compensation for the impacts on adjoining properties for the time and money spent in addressing any defaulting problems?
