The Chairman reports that she has perused the minutes of the meeting of the Open Portion of the Council meeting held on Monday, 20 March 2017, finds them to be a true record and recommends that they be taken as read and signed as a correct record.

That pursuant to the Sullivans Cove Planning Scheme 1997, the Council approve the application for alterations to car park and associated hydraulic infrastructure at 20 McVilly Drive, 1 McVilly Drive and 2 Davies Avenue, Hobart for the reasons outlined in the officer’s report attached to item 7.1.1 of the Open City Planning Committee agenda of 27 March 2017, and a permit containing the following conditions be issued:

The use and/or development must be substantially in accordance with the documents and drawings that comprise PLN­16­1185 ­ 20 McVilly Drive, Hobart ­ 1 McVilly Drive ­ 2 Davies Avenue ­ Final Planning Documents except where modified below.

The development must be drained to the River Derwent via the proposed stormwater main extension and diversion at the developer’s cost. The new stormwater infrastructure must be constructed prior to the first use at the developer’s cost.

Engineering design drawings must be submitted and approved, prior to commencement of work. The engineering drawings must:

1.      Be certified by a qualified and experienced engineer.

2.      Show in both plan and long­section the proposed stormwater mains and outfall, including but not limited to, connections, flows, velocities, hydraulic grade lines, clearances from other services, cover, gradients, sizing, material, pipe class, adequate working platforms around manholes, easements and adequate scour control.  The high water mark and top of embankment must be clearly shown on the outlet plan.

3.      Clearly distinguish between public and private infrastructure.

4.      Be substantially in accordance with the LGAT drawings.

All work required by this condition must be undertaken in accordance with the approved engineering design drawings.

Advice: Once the engineering design drawings have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Please note that once the condition endorsement has been issued you will need to contact Council’s City Infrastructure Division to obtain a Permit to Construct Public Infrastructure.

To ensure Council’s hydraulic infrastructure meets acceptable standards.

Stormwater pre­ treatment for stormwater discharges from the development must be installed prior to first use.

A stormwater management report and design must be submitted and approved, prior to commencement of works. The stormwater management report and design must:

1.      Be prepared by a suitably qualified engineer.

2.      Include detailed design of the proposed treatment train, including final estimations of contaminant removal.

3.      Include a Stormwater Management Summary Plan that outlines the obligations for property owners to stormwater management, including a maintenance plan which outlines the operational and maintenance measures to check and ensure the ongoing effective operation of all systems, such as: inspection frequency; cleanout procedures; descriptions and diagrams of how the installed systems operate; details of the life of assets and replacement requirements.

All work required by this condition must be undertaken and maintained in accordance with the approved stormwater management report and design.

Advice: Once the stormwater management report and design has been approved Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Reason for condition

To avoid the possible pollution of drainage systems and natural watercourses, and to comply with relevant State Legislation.

ENG 8

All parking spaces must be delineated by means of white or yellow lines 80mm to 100mm wide, or white or yellow pavements markers in accordance to Australian/NZS Standard, Parking facilities Part 1: Off­street car parking AS/NZS 2890.1, prior to the commencement of the use.

In the interests of vehicle user safety and the amenity of the development.

All car parking spaces for people with disabilities must be delineated to Australian/NZS Standard, Parking facilities Part 6: Off­street parking for people with disabilities AS/NZS 2890.6: 2009, prior to the commencement of the use.

ENG 1

The cost of repair of any damage to the Council infrastructure resulting from the implementation of this permit, must be met by the owners within 30 days of the completion of the development or as otherwise determined by the Council. Any damage must be immediately reported to the Council.

A photographic record of the Council infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.

A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. In the event that the owner/developer fails to provide to the Council a photographic record of the Council’s infrastructure, then any damage to the Council infrastructure found on completion of works will be deemed to be the responsibility of the owner.

Reason for condition

To ensure that any of the Council infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

ENV 2

Sediment and erosion control measures, sufficient to prevent sediment from leaving the site and in accordance with an approved soil and water management plan (SWMP), must be installed prior to the commencement of work and maintained until such time as all disturbed areas have been stabilised and/or restored or sealed to the Council’s satisfaction.

A SWMP must be submitted and approved, prior to the commencement of work. The SWMP must be prepared in accordance with the Soil and Water Management on Building and Construction Sites fact sheets (Derwent Estuary Program, 2008), available here.

All work required by this condition must be undertaken in accordance with the approved SWMP.

Advice: Once the SWMP has been approved, the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Reason for condition

To avoid the pollution and sedimentation of roads, drains and natural watercourses that could be caused by erosion and runoff from the development.

HER 6

All onsite excavation and ground disturbance on Tasport's land between SW2.1 and SW2.2 (as shown on drawing C11, Revision P1, Drawn by M Richardson, Drawing date 14/12/2016) must be monitored by a qualified archaeologist. Should any features or deposits of an archaeological nature be discovered during excavation or disturbance:

1.      All excavation and/or disturbance must stop immediately; and

2.      A qualified archaeologist must provide advice and assessment of the features and/or deposits discovered and make recommendations on further excavation and/or disturbance; and

3.      All and any recommendations made by the archaeologist engaged in accordance with above must be complied with in full; and

4.      All features and/or deposits discovered must be reported to the Council with 7 days of the discovery; and

5.      A copy of the archaeologist's advice, assessment and recommendations obtained in accordance with paragraph (2) above must be provided to Council within 60 days of receipt of the advice, assessment and recommendations.

Excavation and/or disturbance must not recommence unless and until approval is granted from the Council.

To ensure that work is planned and implemented in a manner that seeks to understand, retain, protect, preserve and manage significant archaeological evidence.

10.      Tasmanian Planning Scheme - State Planning Provisions

That:   1.      The Council write to the Minister for Planning and Local Government expressing the following:

(i)      Council’s concerns regarding the time and resourcing implications of the requirement to prepare statements of local heritage significance for the 1400 local significant properties to be included within the Local Provisions Schedule;

(ii)     Given the significant resourcing implications outlined in clause 1(i) above, what financial assistance will the Government make available to allow the Council to expedite such a requirement;

(iii)    The need, as a matter of priority, to review the residential development standards consistent with the strong recommendation of the Tasmanian Planning Commission and that the Commission be afforded appropriate resourcing to deliver this review; and

(iv)    Council’s continuing concerns that the Tasmania Heritage Registered properties will not have the benefit of being considered under the proposed Local Heritage Code where consideration of streetscape, historic patterns of development, and the ability of the Council to make a thorough and holistic planning assessment as required under the Act.

2.      Council workshops be held once suitable sections of the draft local provisions schedule have been developed. Following these workshops, Council consider community consultation on the draft provisions.

3.      A representative from the Environmental Defenders Office be invited to provide a briefing to Aldermen at the first workshop outlined in clause 2 above, outlining their views on the impacts of the State Planning Provisions on matters such as residential amenity, heritage, landscape and the environment.

2.    If an agreement is reached between Claude Neon and the affected residents that requires an amended planning permit to be issued, that all fees associated with the amended planning permit be waived.

12.      European Union World Cities Project - Katowice Poland

That:   1.      The Council nominate one Alderman to be selected from Aldermen Ruzicka, Denison or Thomas, two Council Officers and two other representatives, one from the University of Tasmania and one from the private sector to form a delegation of five (5) from Hobart, to attend the European Union’s World Cities 2017 Australian initiative.  The Council officer nominations, within the delegation being determined by the General Manager.

                    (i)      Aldermanic representation to be dependent on what the project involves, allowing nominated Aldermen to opt in or opt out of the project.

2.      A media release be prepared announcing the success of the Council in its selection to participate in the European Union’s World Cities 2017 Australian initiative.

3.      Other Aldermen who wish to attend can nominate and apply to use funds allocated as per their Aldermanic Professional Development if deemed appropriate, and agreed to by the European Union organising committee.

13.      kunanyi/Mount Wellington - State Government's Proposed Land Acquisition

“That Council notes that:

·    The Hobart City Council is an active and important caretaker of kunanyi/Mt Wellington, spending significant resources every year on management of the park;

·    Hobart City Council is working proactively to improve and enhance the visitor experience on kunanyi/Mt Wellington and has recently approved the development of three exciting new visitor experiences set out in the One Mountain prospectus;

·    Hobart City Council has approved and is currently developing a major upgrade of the Organ Pipes track and will be spending over $1 million in the next two years to create a world class visitor experience on par with the Wineglass Bay walking track;

And resolves to:

1    Consider a draft letter to the Premier and Minister Groom in respect to the following matters:

1.1    Clarification of the facts regarding the Council’s dealings with the cable car proponent in respect to any request for landowner consent and the lodgement of a development application for the proposal.

1.2    The Government’s failure to consult with the City of Hobart as landowner of the site, prior to announcing its plans in the media.

1.3    The legal basis upon which the government is proposing its action to forcibly acquire City of Hobart land.

2    Request a report from the Acting General Manager prior to the proposed meeting with the Minister on the legal basis for and potential precedent created by the state government's forcible acquisition of Council land. The report also provide advice about issues that a forcible acquisition may raise for Hobart City's assets, day-to-day management and for the current Council projects on kunanyi/Mt Wellington, and all other related matters.

Rationale:

“The State Government announced to the media on 25 February that it has decided to take public land on kunanyi/Mt Wellington from Council ownership. They made this announcement to the media but did not inform the Council, except via a phone call to the Mayor within minutes of informing the media.

The City of Hobart invests significant time and money looking after and providing infrastructure for the mountain park. It is a significant asset to the City of Hobart and the proposal to forcibly acquire council land to facilitate one particular development needs the consideration of and discussion by the Council.”

The Acting General Manager reports:

“In line with the Council’s policy in relation to Notices of Motion, I advise that

the motion is considered to be within the jurisdiction of the Hobart City Council as it relates to the use of Council owned land.”

14.      Australia Day - Council Celebrations

That:     1.      A report be provided to review City of Hobart events commemorating Australia Day on January 26, including first and foremost to consider changing the date of the Hobart citizenship ceremony currently held on January 26th.

2.      The City of Hobart consult with the aboriginal community in order to consider a better date and way of understanding aboriginal culture and history, so that we can all celebrate Australia Day as a nation.

Rationale:

“There is growing understanding that the aboriginal community recognise January 26 as the day their country was invaded. It is not to them a day of celebration.

Whilst there are many events such as Hobart's citizenship ceremony and Hobart's citizens of the year awards held in conjunction with the Sandy Bay Regatta, the first Tasmanians do not celebrate "Australia Day" on this date with other Tasmanians.

This motion calls for the City of Hobart to consult with the aboriginal community in order to consider a better date and way of understanding aboriginal culture and history, so that we can all celebrate Australia as a nation.”

The General Manager reports:

“In line with the Council’s policy in relation to Notices of Motion, I advise that the matter is considered to be within the jurisdiction of the Hobart City Council as it is in line with the Council’s Social Inclusion Strategy 2014-2019 and the Aboriginal Strategy 2002.”

(i)      Surf Life Saving Tasmania hold a lease on the area until September 2020;

(ii)     The Council is progressing a proposal to seek development of a second floor of the building.

That:  1.     The Council receive and note the SGS Economics and Planning Greater Hobart: Local Government Reform Final Feasibility Study.

2.    The Council note the actions which have occurred in respect to the Greater Hobart: Local Government Reform Final Feasibility Study as a result of the 6 March 2017 Council meeting.

3.    Advice be provided to the Committee after the meeting planned with Commissioner Sue Smith of the Glenorchy City Council, currently scheduled for 4 April 2017, has occurred.

4.    The Council then conduct a workshop to facilitate questions and discussion around the Greater Hobart:  Local Government Reform Final Feasibility Study, prior to formal consideration of its position in respect to the Report, going forward.

24.      Statewide Container Deposit System (CDS)

“That the City of Hobart write to the Tasmanian Government lobbying for the introduction of a state wide container deposit system (CDS).”

Rationale:

“The City of Hobart Waste Management Strategy 2015-2030 – a strategy to achieve zero waste to landfill by 2030 contains the following recommendation:

Advocating for Change

1.            1.5  Advocate to State Government to support a state wide Container Deposit System

Tasmania and Victoria are now the only Australian states that have not committed to introducing a Container Deposit Scheme.

The Western Australia and Queensland governments recently committed to introducing a 10c container refund scheme, and the Liberal New South Wales government has already tabled legislation.

It would seem that the time has come for Tasmania to introduce a container deposit scheme and there is a growing public expectation that it should occur.

Tasmania has a reputation as a clean green state and is currently a tourism hot spot, nevertheless, we still have some of the highest levels of litter in the country especially along our roadsides.

Hobart’s foreshore and waterways are still being littered with cans and plastic bottles, which would be eliminated with a container deposit scheme;

Marine plastic pollution, as the council is fully aware, is of growing concern and bottle caps are especially a serious threat for marine and seabird species.

Tasmanians are ready for a CDS and a 2011 opinion poll found 91% of respondents supported the introduction of a CDS in the State, and in South Australia, where a CDS has been operating for nearly 40 years, 98% of South Australians support the CDS.

A CDS has the potential to create a new industry for the state and provide new employment opportunities.

There seems no logical reason for the state government to delay the introduction of a CDS and this council should lend its weight to encouraging the introduction of a scheme as soon as possible.”

“In line with the Council’s policy in relation to Notices of Motion, I advise that the matter is considered to be within the jurisdiction of the Hobart City Council as the Notice relates to The City of Hobart Waste Management Strategy 2015-2030.”

27.      Pedestrian Crossings in Hill Street, West Hobart - Concept Design

That:   1.    Community engagement be undertaken based on the concept design marked as Attachment A to item 6.3 of the Open City Infrastructure Committee agenda of 29 March 2017.

2.    The General Manager work with the schools and interested businesses to lobby the Transport Commissioner for the provision of adult crossing guards at the Hill Street / Lansdowne Crescent / Patrick Street and the Hill Street / Lansdowne Crescent / Pine Street intersections.

3.    Further investigation, including advice from the Transport Commissioner be undertaken to install improved pedestrian crossings at the Hill Street / Lansdowne Crescent / Patrick Street and Hill Street / Lansdowne Crescent / Pine Street intersections taking into consideration sight distance, bus turning and property constraints and in accordance with the Australian Standard.

Options to be investigated include:

(ii)     Wombat crossings at the above roundabouts; and/or

(ii)     Replacing the Hill Street / Lansdowne Crescent / Patrick Street roundabout with traffic signals.

4.    A further report be provided, detailing the results of the community engagement and recommending a design to be implemented in Hill Street, incorporating consideration of the consultation and the feedback from MRCagney and Victoria Walks.

5.    A further report be provided to the Council’s Community, Culture and Events Committee in relation to a possible event and community art project for West Hobart.

6.    The line markings at the Hill Street roundabouts be painted as a matter of urgency.
