The Lord Mayor advise that the Deputy Lord Mayor Alderman Christie had today welcomed to the City, Commander Ian Bray of the submarine HMAS Farncomb and presented him with a plaque on behalf of the City of Hobart.

In accordance with the requirements of the Local Government (Meeting Procedures) Regulations 2015, the General Manager reports that no Council workshops have been conducted since the last ordinary meeting of the Council.

6.1      Proposed Removal of Trees at the Intersection of York and Grace Streets, Sandy Bay

 

The Deputy Lord Deputy presented a petition seeking the Council’s consideration to retain the trees located at the intersection of York and Grace Streets, and to ensure that regular maintenance of the trees is undertaken for the safety of residents and the health of the trees.

There were 19 signatories to the petition.

9.       Council Acting as Planning Authority

 

In accordance with the provisions of Part 2 Regulation 25 of the Local Government (Meeting Procedures) Regulations 2015, the intention of the Council to act as a planning authority pursuant to the Land Use Planning and Approvals Act 1993 is to be noted.

 

In accordance with Regulation 25, the Council will act as a planning authority in respect to those matters appearing under this heading on the agenda, inclusive of any supplementary items.

 

The Council is reminded that in order to comply with Regulation 25(2), the General Manager is to ensure that the reasons for a decision by a Council or Council Committee acting as a planning authority are recorded in the minutes.

 

9.1      53 Runnymede Street, Battery Point - Partial Demolition, Alterations and Extension

That pursuant to the Hobart Interim Planning Scheme 2015, the Council refuse the application for partial demolition, alterations and extension at 53 Runnymede Street, Battery Point for the following reasons:

 

1.      The proposed development does not meet performance criterion E13.7.2 P1 of the Hobart Interim Planning Scheme 2015 as the development will result in loss of historic cultural heritage significance to the place through incompatible design, including in height and form.

 

2.      The proposed development does not meet performance criterion E13.7.2 P2 of the Hobart Interim Planning Scheme 2015 as the development is not designed to be subservient and complementary to the place through characteristics including its built form.

 

3.      The proposed development does not meet performance criterion E13.7.2 P3 of the Hobart Interim Planning Scheme 2015 as the built form does not respond to the dominant heritage characteristics of the place.

 

4.      The proposed development does not meet performance criterion E13.7.2 P4 of the Hobart Interim Planning Scheme 2015 as the extension to the existing building detracts from the historic cultural heritage significance of the place.

 

5.      The proposed development does not meet performance criterion E13.8.4 P3 of the Hobart Interim Planning Scheme 2015 as the height of the proposal will be obtrusive in the streetscape and will detract from the pattern of development that is a characteristic of the cultural heritage significance of Heritage Precinct BP1 in the vicinity of the site.

That pursuant to the Hobart Interim Planning Scheme 2015, the Council approve the application for partial demolition, works and lighting at 19 Lansdowne Crescent, West Hobart for the reasons outlined in the officer’s report attached to item 7.1.2 of the Open City Planning Committee agenda of 17 October 2016, and a permit containing the following conditions be issued:

The cost of repair of any damage to the Council infrastructure resulting from the implementation of this permit, must be met by the owners within 30 days of the completion of the development or as otherwise determined by the Council.

 

 

A photographic record of the Council infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.

 

 

A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. In the event that the owner/developer fails to provide to the Council a photographic record of the Council’s infrastructure, then any damage to the Council infrastructure found on completion of works will be deemed to be the responsibility of the owner.

To ensure that any of the Council infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

Sediment and erosion control measures sufficient to prevent sediment from leaving the site must be installed prior to any disturbance of the site. Sediment controls must be maintained until all areas of disturbance have been stabilized or re vegetated.

9.4      Hobart Interim Planning Scheme 2015 - Planning Scheme Amendment 7/2016 and S43A Permit Application - 4 Lefroy Street, North Hobart

            7/2016 - File Ref: F16/87621

That:   1.     Pursuant to Section 34(1) (b) of the former provisions of the Land Use Planning and Approvals Act 1993, the Council resolve to initiate an amendment to the Hobart Interim Planning Scheme 2015 to rezone part of the property at 4 Lefroy Street North Hobart from Light Industrial to Inner Residential, as indicated on the plans marked as Attachment A to item 7.1.4 of the Open City Planning Committee agenda of 17 October 2016.

2.    Pursuant to Section 35 of the former provisions of the Land Use Planning and Approvals Act 1993, the Council certify that the 7/2016 Amendment to the Hobart Interim Planning Scheme 2015 meets the requirements of Section 32 of the former provisions of the Land Use Planning and Approvals Act 1993 and authorise the General Manager and the Deputy General Manager to sign the Instrument of Certification marked as Attachment C to item 7.1.4 of the Open City Planning Committee agenda of 17 October 2016.

3.    Pursuant to Section 38 of the former provisions of the Land Use Planning and Approvals Act 1993, the Council place the 7/2016 Amendment to the Hobart Interim Planning Scheme 2015 on public exhibition for a 28 day period following certification.

4.    Pursuant to Section 43A of the former provisions of the Land Use Planning and Approvals Act 1993, the Council grant a permit for partial demolition, alterations, change of use to (multiple dwelling) and four multiple dwellings at 4 Lefroy Street, North Hobart and a permit containing the conditions specified in Attachment B to item 7.1.4 of the Open City Planning Committee agenda of 17 October 2016 be issued.

(i)    The permit include the following advice clause:

That consideration be given to lowering the front fence to a height of less than 1.7m, which is more in keeping with the surrounding streetscape.

A construction waste management plan must be implemented throughout construction.

 

 

A construction waste management plan must be submitted and approved, prior to commencement of work on the site. The Construction Waste Management Plan must include:

 

 

1.        Provisions for the handling transport and disposal of demolition material, including any contaminated waste, to satisfy the above requirement.

 

 

All work required by this condition must be undertaken in accordance with the approved construction waste management plan.

 

 

Advice: Once the Construction Waste Management Plan has been approved Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

 

 

Reason for condition

 

 

To ensure that solid waste management from the site meets the Council’s requirements and standards.

 

 

ENG sw2

 

 

The cost of any alterations and repairs to the Council’s or third­party infrastructure incurred as a result of the proposed development works must be met by the owner.

 

 

Advice: Should any third­party pipes be found onsite, please notify Council's Senior Plumbing Compliance Officer on 6238 2825.

 

 

Reason for condition

 

 

To ensure that any of the Council infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

 

 

ENG sw4

 

 

The development (including hardstand) must be drained to Council infrastructure. The new stormwater connection must be constructed, and all existing connections be abandoned and sealed, by Council at the owner’s expense prior to the first occupation.

 

 

Detailed engineering drawings must be submitted and approved, prior to commencement of work. The detailed engineering drawings must include:

 

a.        the location of the proposed connections and all existing connections;

b.        the size and design of the connection such that they are appropriate to safely service the development;

c.        long­sections of the proposed connection clearly showing clearances from any nearby services, cover, size, material and delineation of public and private infrastructure; and

d.        all private stormwater contained fully within the boundaries of the Lot serviced.

 

All work required by this condition must be undertaken in accordance with the approved engineering drawings.

 

 

Advice: Once the engineering drawing has been approved, the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

 

Council notes the existing pit over Council’s stormwater main passing through the site must be retained.

 

 

Please note that once the condition endorsement has been issued you will need to contact Council’s City Infrastructure Division to initiate an application for service connection.

To ensure the site is drained adequately.

 

 

ENG sw7

 

 

Stormwater pre­ treatment for stormwater discharges from the development must be installed prior to issue of a Certificate of Completion.

 

 

A stormwater management report and design must be submitted and approved, prior to issue of any consent under the Building Act or commencement of works (whichever occurs first). The stormwater management report and design must:

 

 

a   be prepared by a suitably qualified engineer;

 b   include detailed design of the proposed treatment train, including final estimations of contaminant removal; and

c   Include a Stormwater Management Summary Plan that outlines the obligations for future property owners to stormwater management, including a maintenance plan which outlines the operational and maintenance measures to check and ensure the ongoing effective operation of all systems, such as: inspection frequency; cleanout procedures; descriptions and diagrams of how the installed systems operate; details of the life of assets and replacement requirements.

 

 

All work required by this condition must be undertaken and maintained in accordance with the approved stormwater management report and design.

 

 

Advice: Once the stormwater management report and design has been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement). Council notes the treatment for vehicular storage and carparking areas should target heavy metals (i.e. the fine fraction of particles) and hydrocarbons.

 

 

Reason for condition

 

 

To avoid the possible pollution of drainage systems and natural watercourses, to comply with relevant State legislation, and to ensure the development’s stormwater system takes into account limited receiving capacity of Council’s infrastructure.

 

 

ENG 2

 

 

Vehicle crash barriers compliant with the Australian/New Zealand Standard AS

/ NZS 1170.1 must be installed prior to the first occupation.

Adequate space for onsite turning must be provided so that standard B85 vehicles (as per AS2890) can leave the site in a forward direction.

That the Council request a report to review the Council’s 2012 ‘framework’ regarding the use of parking spaces for outdoor dining, taking into account the following changes that have taken place since 2012, namely:

 

(i)      The Council’s decision of October 2015 to restrict new occupation licences for outdoor dining on footpaths, based on changes to improve the pedestrian access and safety on city footpaths; and

 

(ii)     The increased adoption of ‘parklet policies’ in a number of cities around Australia and around the world to encourage the low-cost activation of streets.

 

Rationale:

 

·        A number of small businesses in Hobart are looking for opportunities to increase the opportunity for outdoor dining and many residents are attracted to streets that have street dining options.

 

·        Council’s decision in 2012 on the use of car parks for outdoor dining was a useful response to a specific request at the time, but the current ‘framework’ is complex and does little to encourage the expanded use of ‘parklets’ in the city.

 

·        Parklets are becoming an increasingly popular tool used by Councils around Australia and the world to activate streets in a low-cost and temporary way without having to make expensive changes in civil infrastructure.

 

·        Parklets are public seating platforms that can convert suitable parking spaces into vibrant community spaces. They are the product of a partnership between a city and local businesses, residents, or community associations.

 

·        Most parklets have a distinctive design (like the one pictured) that incorporate seating, greenery and accommodates demand for public space or outdoor dining on thriving neighbourhood retail streets or commercial areas.

·        There are numerous studies about the economic and social returns to the city of implementing a policy to encourage the use of parklets. These can be drawn on to review and update our current approach.

 

·        Council policies to encourage the use of ‘parklets’ have been central to recent revitalisation strategies in Melbourne, City of Hume, City of Wyndham, Central Geelong and the Shepparton CBD, to name just a few.

 

·        There is value in Council reviewing its current approach in light of rapidly changing urban design trends and in the context of Council’s efforts to revitalise and modernise a number of city areas and neighbourhood shopping precincts.

(i)      The project recommended for full funding from the August round of the Community Development Grants Program as detailed in Table 1 of Attachment A;

(iii)    The projects listed in Table 3 of Attachment A not be recommended for funding.

2.      The value of the recommended projects is $37,010 for Creative Hobart Medium and Small Grants, $22,679 for Community Grants and $126,830 for Event Grants.

3.      The Council provide financial support to the value of $7,000 to the Cruising Yacht Club of Australia for the 2016 Sydney to Hobart Yacht Race.

4.      The funding for these grants be attributed to the respective Community Development Policy Management, Cultural Programs and Major Events and Grant Funding activities in the 2016/2017 Annual Plan.

5.      The grant applicants be advised of the decision accordingly.

COUNCIL RESOLUTION:

 

 

That:     1.           The Council approve the recommended level of funding to the respective applicants for assistance as part of the 2016/2017 Community Development Grants Program, under the streams of Creative Hobart, Community and Events, outlined in Attachment A to item 6.2 of the Open Community, Culture and Events Committee agenda of 12 October 2016, as detailed below:

(i)      The project recommended for full funding from the August round of the Community Development Grants Program as detailed in Table 1 of Attachment A;

(ii)     The project recommended for partial funding from the August round of the Community Development Grants Program as detailed in Table 2 of Attachment A;

(iii)    The projects listed in Table 3 of Attachment A not be recommended for funding.

2.      The value of the recommended projects is $37,010 for Creative Hobart Medium and Small Grants, $22,679 for Community Grants and $126,830 for Event Grants.

3.      The Council provide financial support to the value of $7,000 to the Cruising Yacht Club of Australia for the 2016 Sydney to Hobart Yacht Race.

4.      The funding for these grants be attributed to the respective Community Development Policy Management, Cultural Programs and Major Events and Grant Funding activities in the 2016/2017 Annual Plan.

5.      The grant applicants be advised of the decision accordingly.

6.      The total grant provisions be recorded in the ‘Grants, Assistance and Benefits Provided’ section of the City of Hobart’s Annual Report in accordance with the Council’s policy on grants and benefits disclosure.

18.      Tidal Pools Sculpture - Lower Sandy Bay

That:     1.      The request from Elizabeth Walker, widow of the late artist Stephen Walker AM, seeking the removal of car parking from in front of the ‘Tidal Pools’ sculpture located adjacent to Beach Road at Lower Sandy Bay, in order to improve the amenity and views of the sculpture, be declined.

2.      No change be made to the existing parking arrangements in the Beach Road parking area at the current time.

3.      Council officers continue to explore other options in regard to Elizabeth Walker’s concerns associated with ‘Tidal Pools’, where possible.
