The Lord Mayor noted the presentation of a plaque to the Council by Captain Paul Karpo Mandziy, Commander of the HMAS Adelaide at an exchange of plaques which occurred on 19 August 2016.

RECOMMENDATION

 

That the Council resolve to deal with any supplementary items not appearing on the agenda, as reported by the General Manager in accordance with the provisions of the Local Government (Meeting Procedures) Regulations 2015.

9.       Council Acting as Planning Authority

 

In accordance with the provisions of Part 2 Regulation 25 of the Local Government (Meeting Procedures) Regulations 2015, the intention of the Council to act as a planning authority pursuant to the Land Use Planning and Approvals Act 1993 is to be noted.

 

In accordance with Regulation 25, the Council will act as a planning authority in respect to those matters appearing under this heading on the agenda, inclusive of any supplementary items.

 

The Council is reminded that in order to comply with Regulation 25(2), the General Manager is to ensure that the reasons for a decision by a Council or Council Committee acting as a planning authority are recorded in the minutes.

9.2     2 Davies Avenue, Queens Domain - Partial Demolition, Alterations, Extension, Fencing and Associated Hydraulic Infrastructure

That pursuant to the Hobart Interim Planning Scheme 2015, the Council approve the application for partial demolition, alterations, extension, fencing and

associated hydraulic infrastructure at 2 Davies Avenue, Hobart for the reasons outlined in the officer’s report attached to item 3.2.1 of the Special Open City Planning Committee agenda of 22 August 2016, and a permit containing the following conditions be issued:

GEN

The use and/or development must be substantially in accordance with the documents and drawings that comprise PLN­16­00674­01 ­ 2 Davies Avenue ­ Queens Domain ­ Final Planning Documents except where modified below.

Reason for condition

To clarify the scope of the permit.

ENGsw4

Any new stormwater connection required must be constructed and existing connection to be abandoned must be sealed by the Council at the owner’s expense, prior to issue of a Certificate of Completion.

Detailed design drawings and calculations must be submitted and approved, prior to issue of any consent under the Building Act 2000. The detailed design drawings must include:

(i)     the location of the proposed connection; and

(ii)    the size of the connection appropriate to satisfy the needs of the development; and

(iii)    a longsection of the proposed connection clearly showing all potential clashes and cover; and

(iv)   material of the connection; and

(v)    clearly distinguish between public and private infrastructure.

All work required by this condition must be undertaken in accordance with the approved detailed design drawings.

Advice: Once the detailed design drawings have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Please note that once the condition endorsement has been issued you will need to contact Council’s City Infrastructure Unit to initiate an application for service connection.

Reason for condition

To ensure the site is drained adequately.

ENV1

Sediment and erosion control measures sufficient to prevent sediment from leaving the site must be installed prior to any disturbance of the site. Sediment controls must be maintained until all areas of disturbance have been stabilized or re vegetated.

Advice: For further guidance in preparing a Soil and Water Management Plans (SWMP) in accordance with Fact sheet 3 Derwent Estuary Program go to
www.hobartcity.com.au development engineering standards and guidelines.

Reason for condition

To avoid the sedimentation of roads, drains, natural watercourses, the Council land that could be caused by erosion and runoff from the development, and to comply with relevant State legislation.

 

Excavation and/or disturbance must not recommence unless and until approval is granted from the Council’s Senior Cultural Heritage Officer.

Reason for condition

To ensure that the work complies with the conservation principles, processes and practices set down in the Burra Charter, in accordance with Section E13.10 of the Hobart Interim Planning Scheme 2015 and to ensure the preservation of any remnant heritage artefacts uncovered are assessed professionally for their potential historical/cultural worth and for their contribution to an understanding of the site and its surrounds.

HER 7

Archival quality annotated photographs and drawings of the building and features for demolition must be recorded prior to commencement of work.

The photographs and drawings must be submitted and approved, prior to the commencement of construction work. The photographs and drawings must include:

(i)     Each elevation of the building earmarked for demolition;

(ii)    The interior of the building;

(iii)    Any early/historic architectural detailing of the building.

 

The recording must contain both electronic and hard copy colour images with cross referencing of all photographs to “as existing plan showing the location and orientation of the camera.

Advice: Once the annotated photographs and drawings have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Reason for condition

To ensure recognition of the historic cultural heritage significance of the place.

HER 8

Salvage must be undertaken to ensure the protection and/or reuse of any heritage fabric that can be satisfactorily reused.

Documentation must be submitted for approval prior to the commencement of work. The documents must outline the proposed salvage, retrieval and recycle options of the following building fabric, to satisfy the above requirement:

(i)     weatherboards;

(ii)    windows;

(iii)    doors;

(iv)   any other joinery items.

 

All work required by this condition must be undertaken in accordance with the approved documents.

Advice: Once the documents have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Reason for condition

To ensure that demolition in whole or part of a place within the cultural heritage precinct does not result in the loss of historic cultural heritage values unless there are exceptional circumstance.

9.3     40 Elizabeth Street and Adjacent Road Reservation, Hobart - Demolition and New Building for General Retail and Hire and Business and Professional Services

That pursuant to the Hobart Interim Planning Scheme 2015, the Council approve the application for demolition and new building for general retail and hire and business and professional services at 40 Elizabeth Street, Hobart for the reasons outlined in the officer’s report attached to item 3.2.2 of the Special Open City Planning Committee agenda of 22 August 2016, and a permit containing the following conditions be issued:

The use and/or development must be substantially in accordance with the documents and drawings that comprise PLN­16­00152­01 ­ 40 Elizabeth Street­ Hobart ­ Final Planning Documents except where modified below.

Reason for condition

To clarify the scope of the permit.

TW

The use and/or development must comply with the requirements of TasWater as detailed in the form Submission to Planning Authority Notice, Reference No. TWDA 2016/00197­HCC dated 12/7/16 as attached to the permit.

Each of the office levels in the building must provide a minimum of two bicycle parking/storage spaces prior to the first occupation of the office space.

ENGsw4

The development must be drained to Council infrastructure. Any new stormwater connection(s) required must be constructed, and existing redundant connections must be sealed, by the Council at the owner’s cost prior to issue of a Certificate of Completion.

Detailed design drawings showing both existing and proposed services must be submitted and approved, prior to issue of any consent under the Building Act 2000. The detailed design drawings must include:

(i)     the location of the proposed connections and all existing connections;

(ii)    the size of the connection(s) such that they are appropriate to service the development;

(iii)    long-sections of the proposed connection(s) clearly showing any nearby services, cover, size, material and delineation of public and private infrastructure; and

(iv)   be checked and certified by a qualified and experienced engineer.

All work required by this condition must be undertaken in accordance with the approved detailed design drawings.

Advice: Once the detailed design drawings have been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Please note that once the condition endorsement has been issued you will need to contact Council’s City Infrastructure Division to initiate an application for service connection.

Reason for condition

To ensure the site is drained adequately.

ENG 1

The cost of repair of any damage to the Council infrastructure resulting from the implementation of this permit, must be met by the owners within 30 days of the completion of the development or as otherwise determined by the Council.

A photographic record of the Council infrastructure adjacent to the subject site must be provided to the Council prior to any commencement of works.

A photographic record of the Council’s infrastructure (e.g. existing property service connection points, roads, buildings, stormwater, footpaths, driveway crossovers and nature strips, including if any, pre existing damage) will be relied upon to establish the extent of damage caused to the Council’s infrastructure during construction. In the event that the owner/developer fails to provide to the Council a photographic record of the Council’s infrastructure, then any damage to the Council infrastructure found on completion of works will be deemed to be the responsibility of the owner.

Reason for condition

To ensure that any of the Council infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

ENGR 1

The excavation, footings and/or building within or supporting the highway reservation must not undermine the stability and integrity of the highway reservation and its infrastructure.

Detailed design drawings and structural certificates of the excavation, footings and/or building within or supporting the Collins Street and Elizabeth Street highway reservation must be submitted and approved, prior to the commencement of work and must:

(i)     Be prepared and certified by a suitable qualified person and experienced engineer;

(ii)    Not undermine the stability of the highway reservation;

(iii)    Take into account any additional surcharge loadings as required by relevant Australian Standards;

(iv)   Take into account and reference accordingly any Geotechnical findings;

(v)    Detail any mitigation measures required, in particular how the pavers within the Collins Street and Elizabeth Street highway reservation will not be damaged; and

(vi)   The structure certificated and/or drawings should note accordingly the above.

All work required by this condition must be undertaken in accordance with the approved select design drawing and structural certificates.

Advice: Once the design drawing has been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Reason for condition

To ensure that the stability and integrity of the Council’s highway reservation is not compromised by the development.

ENG s1

The cost of any alterations to the Council’s or third­party infrastructure, including the site’s service connection points, incurred as a result of the proposed development works must be met by the owner.

Reason for condition

To ensure that any of the Council infrastructure and/or site­related service connections affected by the proposal will be altered and/or reinstated at the owner’s full cost.

ENG s2

The Council pavers within the title of the property that will be removed as part of the development must be removed and transported to Council’s depot, prior to the commencement of works. The pavers must not be damaged during the removal.

Advice: Please contact Council on 62382711 to arrange the storage of the pavers.

Reason for condition

To ensure Council’s infrastructure is protected.

ENV2

Sediment and erosion control measures sufficient to prevent sediment from leaving the site must be installed, prior to the commencement of work and maintained until such time as all disturbed areas have been stabilised and/or restored or sealed to the Council’s satisfaction.

A soil and water management plan (SWMP) must be submitted and approved, prior to the commencement of work. The SWMP must:

        (a)    be prepared in accordance with the Soil and Water                           Management on Building and Construction Sites fact sheets                     (Derwent Estuary Program, 2008).

All work required by this condition must be undertaken in accordance with the approved SWMP.

Advice: Once the SWMP has been approved the Council will issue a condition endorsement (see general advice on how to obtain condition endorsement).

Reason for Condition

To avoid the pollution and sedimentation of roads, drains and natural watercourses that could be caused by erosion and runoff from the development.

SURV 8

The applicant, at no cost to the Council shall have prepared, entered into, and have registered at the Land Titles Office, a deed pursuant to Section 75CA of the Conveyancing and Law of Property Act 1884 for the awning encroachment over Collins and Elizabeth Streets, prior to the issue of a completion certificate.

Advice: A Section 75CA Conveyancing & Law of Property Act 1884 ) certificate for the occupation of a Highway requires that the encroachment is a minimum 2.40 metres above the footpath or 4.25 metres above the road carriageway. A 600mm set back from the back of kerb may also be required.

The applicant must prepare and forward the required instrument pursuant to section 75CA Conveyancing & Law of Property Act 1884, including a survey plan of the encroachment (certified by a registered surveyor), the associated $220 Council application fee and the Land Titles Office registration fee, to the Council for execution and subsequent registration within the Land Titles Office.

Reason for Condition

To ensure that the proposed or existing building encroachment over Collins and Elizabeth Streets are formalised in accordance with statutory provisions.

Part 5 r1

Part 5 1 The owner(s) of the property must enter into an agreement with the Council pursuant to Part 5 of the Land Use Planning and Approvals Act 1993 with respect to the protection of excavation, footings and/or building adjacent to the Collins Street and Elizabeth Street highway reservation prior to the commencement of work.

The owner must not undertake any works at any time (including excavation and building) that will have any effect on the integrity of the Collins Street and Elizabeth Street highway reservation or undermine the structural integrity of the highway reservation.

All costs for the preparation and registration of the Part 5 Agreement must be met by the owner.

The owner must comply with the Part 5 Agreement which will be placed on the property title.

To ensure the protection of Council are retained.

HERs1

Prior to works commencing on site or to the issue of any building consent under the Building Act 2000 (whichever occurs first) a Statement of Historical Archaeological Potential in the form of an illustrated report must be submitted to and approved by the Council’s Director City Planning.  The Statement of Historical Archaeological Potential must be prepared a suitably qualified archaeologist and must provide:

a)     A review of the site and disturbance history to predict sensitivity and historical archaeological potential;

b)     Identification of the archaeological values of the place; and

c)     Guidance on an appropriate course of action to protect those values.

 

When approved the document will form part of this permit and must be adhered to.

Reason for condition

All onsite excavation and disturbance must be monitored in accordance with all recommendations made in the approved Statement of Historical Archaeological Potential.

Prior to works commencing on site or to the issue of any building consent under the Building Act 2000 (whichever occurs first) an amended site plan identifying the areas of archaeological monitoring and listing the procedures that will be undertaken to comply with this condition must be submitted to and approved by the Council’s Director City Planning.  When approved the amended plan will form part of this permit and must be adhered to.

Reason for condition

To ensure that the work complies with the conservation principles, processes and practices set down in the Burra Charter, in accordance with Section E13.10 of the Hobart Interim Planning Scheme 2015 and to ensure the preservation of any remnant heritage artefacts uncovered are assessed professionally for their potential historical/cultural worth and for their contribution to an understanding of the site and its surrounds.

Should any features or deposits of an archaeological nature and/or previously unrecognised heritage fabric be discovered anywhere on the site during excavation or disturbance:

(a)    all demolition, excavation and/or disturbance is to stop immediately;

(b)    a qualified archaeologist must be engaged to attend the site and provide advice and assessment of the features and/or deposits discovered and make recommendations on further excavation and/or disturbance;

(c)    all and any recommendations made by the archaeologist engaged in accordance with (b) above must be complied within in full;

(d)    all features and/or deposits discovered must be reported to the Hobart City Council with 7 days of the discovery; and

(e)    a copy of the archaeologist’s advice, assessment and recommendations obtained in accordance with paragraph (b) above must be provided to the Hobart City Council within 14 days of receipt of the advice, assessment and recommendations.

A construction waste management plan must be implemented throughout construction.

A construction waste management plan must be submitted and approved, prior to commencement of work on the site. The construction waste management plan must include:

•       Provisions for commercial waste services for the handling, storage, transport and disposal of post-construction solid waste and recycle bins from the development.

•       Provisions for the handling, transport and disposal of demolition material, including any contaminated waste and recycling opportunities, to satisfy the above requirement.

 

All work required by this condition must be undertaken in accordance with the approved construction waste management plan

Advice: Once the construction waste management plan has been approved Council will issue a condition endorsement (see general advice on how to obtain condition endorsement)

(iii)  An additional amount of $10,000 cash be offered to the MyState Australian Wooden Boat Festival 2017, dependent on the outcome of negotiations for additional benefits above those outlined within their funding application.

 

(iv) The General Manager be delegated the authority to negotiate further benefits to be delivered for the additional funding of $10,000 cash for the MyState Australian Wooden Boat Festival 2017.

 

(a)    These grants be funded from the Major Event and Festival Grants function areas of the 2016/2017 Annual Plan.

 

        2.     An allocation of $80,000 cash and up to $6,600 in-kind support be provided to the 2017 Festival of Voices event to be funded from the Major Event and Festival Grants funding activity in the 2017/2018 Annual Plan.

 

3.     Given the anticipated high level of demand for the twice yearly rounds of the Event Grants stream (up to $20,000), the Council reallocate the remaining funds of $100,000 to this grant pool allocation.
